Terms of Service

Effective date: 13 July 2026

These Terms of Service (“Terms”) apply to your access to and use of Pica Cast, including the Pica Cast website, platform, software and related services (collectively, the “Service”).

Pica Cast is a product and service operated by PICA CAST PTY LTD (Australian Company Number 700 327 788, ABN 79 700 327 788), based in Sydney, New South Wales, Australia.

In these Terms, “Pica Cast”, “we”, “us” and “our” refer to PICA CAST PTY LTD.

“You” and “your” refer to the individual, company, agency or other organisation that accesses or uses the Service.

By creating an account, beginning a free trial, purchasing a subscription or otherwise accessing or using Pica Cast, you agree to these Terms and our Privacy Policy.

1. Eligibility and Authority

You must be at least 18 years old and have the legal capacity to enter into a binding agreement in order to use Pica Cast.

If you access or use Pica Cast on behalf of a company, agency or other organisation, you confirm that:

  • You have authority to agree to these Terms on behalf of that organisation.

  • The organisation agrees to comply with these Terms.

  • You are authorised to provide any information or materials submitted through the Service.

Pica Cast is primarily designed for business and professional use.

2. Accounts

Certain features of Pica Cast may require you to create an account.

When using an account, you agree to:

  • Provide accurate, complete and current information.

  • Keep your login credentials confidential.

  • Take reasonable steps to protect the security of your account.

  • Update your account information when it changes.

  • Notify us promptly if you believe your account has been accessed without authorisation.

  • Accept responsibility for activity carried out through your account.

Individual accounts must not be shared beyond the permissions included in the applicable subscription plan.

Where an organisation has multiple users, the account owner or administrator is responsible for managing user access, roles and permissions.

3. The Pica Cast Service

Pica Cast may provide functionality including:

  • Creator discovery and search.

  • Creator profile analysis and evaluation.

  • Creator recommendations and matching.

  • Creator list and relationship management.

  • Campaign creation and management.

  • Search history and saved searches.

  • Creator outreach and communication tools.

  • Email templates and communication records.

  • AI-assisted summaries, recommendations and content generation.

  • Workspace and team collaboration.

  • Uploading campaign briefs, files and links.

  • Subscription, billing and usage management.

Available functionality may depend on your subscription plan, account settings, geographic location and service availability.

As Pica Cast develops, we may introduce, modify, improve or discontinue features.

4. Free Trials

Pica Cast may provide free trials or other forms of limited free access.

The length of a trial, included functionality and applicable usage limits will be communicated when the trial is offered.

If a free trial requires a payment method and automatically converts into a paid subscription:

  • The automatic conversion will be disclosed before the trial begins.

  • You authorise the relevant payment provider to charge the displayed subscription fee when the trial ends.

  • You must cancel before the trial expires if you do not wish to incur the first subscription charge.

We may restrict eligibility for free trials and may prevent repeated creation of accounts for the purpose of obtaining additional trial periods.

5. Subscription Plans

Pica Cast may offer monthly subscription plans, additional features, usage credits and other add-on purchases.

Information associated with a subscription may include:

  • Subscription price.

  • Billing frequency.

  • Included features.

  • Usage limits.

  • Number of authorised users.

  • Trial conditions.

  • Renewal date.

  • Applicable taxes.

The plan information displayed at checkout or within your account forms part of the agreement between you and Pica Cast.

6. Payments

Payments may be processed through third-party payment providers, which may include:

  • Stripe.

  • Wix Payments.

  • PayPal.

When you purchase a subscription, additional feature or other paid service, you authorise the applicable payment provider to charge your selected payment method for applicable amounts, including:

  • Subscription fees.

  • Renewal fees.

  • Add-on purchases.

  • Usage-based charges, where applicable.

  • Taxes and other charges disclosed before purchase.

Pica Cast does not directly collect or store your complete payment card information.

You are responsible for keeping your payment and billing information accurate and current.

If a payment cannot be successfully processed, we may take reasonable steps including:

  • Retrying the payment.

  • Requesting an updated payment method.

  • Restricting access to paid functionality.

  • Suspending or downgrading your account.

  • Ending the subscription after reasonable notice.

7. Automatic Renewal

Unless otherwise stated during checkout, paid subscriptions renew automatically at the end of each monthly billing period.

Your selected payment method may be charged the applicable renewal fee unless you cancel your subscription before the next billing date.

Information about automatic renewal, applicable pricing and cancellation should also be presented during the purchasing process.

8. Price and Plan Changes

We may change subscription prices, usage allowances or features included within a plan.

Where a change materially affects an existing paid subscription, we will take reasonable steps to notify affected customers before the change applies to a future billing period.

You may cancel your subscription before the new price or material change becomes effective.

A price increase will not be retrospectively applied to a billing period that has already been paid.

9. Cancellation

You may cancel your subscription using available billing or account settings within the Service or by contacting us at hello@picacast.com.

Unless otherwise stated:

  • Cancellation prevents the next automatic renewal.

  • You may continue using paid features until the end of the current paid billing period.

  • After the billing period ends, your account may be downgraded, restricted or closed.

  • Cancelling a subscription does not automatically delete your account or User Content.

  • You should cancel before your next renewal date if you wish to avoid the next subscription charge.

Deleting an application, leaving a workspace or simply stopping use of Pica Cast does not automatically cancel a paid subscription.

10. Refunds

Except where required by applicable law, payments made to Pica Cast are generally non-refundable.

We do not normally provide refunds or prorated credits solely because of:

  • A change of mind.

  • Unused subscription time.

  • Failure to use available features.

  • Failure to cancel before a renewal date.

  • Results not meeting subjective expectations.

  • Account restrictions resulting from a material breach of these Terms.

We may consider refund requests individually in circumstances including:

  • Duplicate charges.

  • Confirmed billing errors.

  • Significant technical failures.

  • Charges occurring after a properly completed cancellation.

  • Exceptional circumstances.

  • Circumstances in which a refund or another remedy is required by law.

Nothing in these Terms is intended to exclude, restrict or modify consumer guarantees, statutory rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.

Depending on the circumstances, applicable consumer rights may include having a service supplied again, cancellation or a refund.

11. User Content

“User Content” means information or materials that you submit, upload, save, generate or transmit through Pica Cast.

User Content may include:

  • Search requests.

  • Campaign briefs.

  • Creator lists.

  • Notes and tags.

  • Files and links.

  • Email templates.

  • Outreach messages.

  • Communication records.

  • Company and product information.

  • Feedback and customer support requests.

You retain ownership of your original User Content.

You grant Pica Cast a limited, non-exclusive and worldwide licence to host, store, copy, process, transmit and display your User Content only to the extent reasonably necessary to:

  • Provide and operate the Service.

  • Produce requested search, recommendation and analysis results.

  • Operate integrations authorised by you.

  • Facilitate communications requested by you.

  • Maintain security and prevent misuse.

  • Diagnose and resolve technical problems.

  • Meet applicable legal obligations.

  • Improve the reliability and functionality of the Service using aggregated or de-identified information.

You confirm that you have the rights, permissions and lawful authority required for the User Content you submit or process through Pica Cast.

12. Creator and Third-Party Information

Pica Cast may process information relating to creators and other third parties from sources including:

  • Users of Pica Cast.

  • Publicly accessible sources.

  • Appropriately licensed sources.

  • Third-party data providers.

  • Third-party integrations.

  • Creators or their authorised representatives.

Creator information may include names, usernames, social media profiles, publicly available contact details, content, audience estimates, engagement information and publicly observable brand collaborations.

Creator or third-party information may not always be:

  • Complete.

  • Accurate.

  • Current.

  • Authentic.

  • Available.

  • Suitable for a particular campaign or commercial purpose.

You are responsible for independently checking information that is material to your decision before contacting a creator, making a commercial decision or entering into an agreement.

Access to creator information through Pica Cast does not give you ownership of a creator's name, image, content, trademarks or other intellectual property.

13. Creator Outreach and Communications

You are responsible for communications sent, scheduled or managed through your Pica Cast account.

You must ensure that communications sent using Pica Cast:

  • Comply with applicable privacy, anti-spam, advertising and marketing laws.

  • Are supported by any consent or other legal authority required by applicable law.

  • Accurately identify the sender.

  • Are not deceptive or misleading.

  • Include an unsubscribe or opt-out mechanism where legally required.

  • Respect valid unsubscribe and opt-out requests.

  • Do not constitute harassment, threats or unlawful discrimination.

  • Do not infringe intellectual property, privacy or other legal rights.

Australian commercial electronic messaging requirements may require appropriate consent, accurate sender identification and a functional unsubscribe mechanism.

Where applicable, unsubscribe requests should be processed within the legally required period.

You must not use Pica Cast for indiscriminate, unlawful, deceptive or abusive bulk communications.

Pica Cast does not guarantee that a communication will be delivered, opened, read, answered or accepted by a creator.

14. AI-Assisted Features

Pica Cast may use artificial intelligence and automated technologies to generate or assist with:

  • Creator recommendations.

  • Search and matching results.

  • Creator profile evaluations.

  • Summaries.

  • Campaign insights.

  • Suggested email content.

  • Draft communications.

  • Other automated outputs.

AI-generated outputs may contain:

  • Errors.

  • Missing information.

  • Outdated information.

  • Biased or unexpected results.

  • Material that may not be appropriate for your intended purpose.

You are responsible for reviewing and verifying AI-generated outputs before:

  • Relying on them.

  • Sending communications.

  • Publishing content.

  • Making commercial decisions.

  • Entering into agreements with creators, customers or other parties.

AI-generated outputs do not constitute legal, financial, employment, tax or other professional advice.

Pica Cast does not guarantee any particular creator, campaign, engagement, revenue or return-on-investment outcome.

15. Acceptable Use

You must not use Pica Cast to:

  • Violate applicable laws or regulations.

  • Infringe another person's privacy, intellectual property or other legal rights.

  • Harass, threaten, deceive or impersonate another person.

  • Send spam or unlawful commercial communications.

  • Process information without the required authority.

  • Misrepresent creator, campaign or performance information.

  • Upload malware, malicious code or other harmful material.

  • Obtain or attempt to obtain unauthorised access to accounts, systems or data.

  • Circumvent security measures, usage limits or access controls.

  • Interfere with the operation, security or availability of the Service.

  • Reverse engineer, reproduce or copy the Service except where permitted by law.

  • Scrape, extract or redistribute Pica Cast data without our written permission.

  • Resell platform access or Pica Cast data without our written permission.

  • Use automated processes that create an unreasonable burden on the Service or infrastructure.

  • Use creator information for unlawful surveillance, profiling or discrimination.

  • Use the Service in violation of applicable third-party platform rules.

  • Falsely suggest or claim an affiliation with Pica Cast or another organisation.

16. Intellectual Property

Pica Cast and its licensors retain all rights, title and interest in the Service and associated intellectual property, including:

  • Software and source code.

  • Product designs and interfaces.

  • Branding and logos.

  • Documentation.

  • Workflows and platform structure.

  • Proprietary databases.

  • Original website and platform content.

  • Updates, modifications and improvements.

Subject to these Terms and payment of applicable fees, Pica Cast grants you a limited, revocable, non-exclusive and non-transferable right to access and use the Service for your internal business or professional purposes.

No ownership interest in Pica Cast or its intellectual property is transferred to you.

17. Feedback

You may provide ideas, suggestions, comments or other feedback relating to Pica Cast.

You give us permission to use that feedback for the development and improvement of Pica Cast without restriction or payment.

We will not publicly identify you as the source of feedback without your permission.

18. Third-Party Services

Pica Cast may integrate with or rely upon third-party products and services, including:

  • Wix.

  • Zoho.

  • Alibaba Cloud.

  • Microsoft Entra.

  • Stripe.

  • Wix Payments.

  • PayPal.

  • AI and automation providers.

  • Analytics providers.

  • Email and communications providers.

  • Social media and creator-data platforms.

Your use of third-party services may also be governed by the applicable third party's terms and privacy policies.

Pica Cast is not responsible for matters outside our reasonable control, including:

  • Third-party outages.

  • Changes to third-party products, APIs or policies.

  • Restrictions placed on your third-party accounts.

  • Third-party-controlled content.

  • Failures of external systems or services.

Unless expressly stated otherwise, Pica Cast is not affiliated with or endorsed by Instagram, Meta, TikTok, YouTube, X or other third-party platforms.

19. Service Availability

We aim to provide a reliable Service but cannot guarantee that Pica Cast will always operate without interruption or error.

Temporary interruptions may occur due to:

  • Scheduled maintenance.

  • Emergency maintenance.

  • Security incidents.

  • Software or infrastructure problems.

  • Third-party service outages.

  • Internet or telecommunications failures.

  • Events beyond our reasonable control.

We may introduce reasonable technical restrictions, usage limits or other controls where necessary to maintain security, platform stability and fair access.

20. Changes to the Service

Pica Cast may update, modify, replace or discontinue features as the Service develops.

Where a change materially reduces the core functionality available under an existing paid subscription, we will take reasonable steps to notify affected users.

Where appropriate, users may cancel their subscription before a material change becomes effective.

21. Suspension and Termination

We may restrict, suspend or terminate access to Pica Cast where reasonably necessary as a result of:

  • A material breach of these Terms.

  • Non-payment.

  • Fraud or suspected fraud.

  • Unlawful activity.

  • Security risks.

  • Harm or potential harm to users, creators, third parties or the Service.

  • Repeated or serious misuse.

  • A legal or regulatory requirement.

Where appropriate, we may provide notice and an opportunity to address or correct the issue.

We may act without prior notice where immediate action is reasonably necessary to protect users, creators, third parties, data or the security of the platform.

You may stop using Pica Cast at any time.

Cancellation of paid subscriptions remains subject to Section 9 of these Terms.

22. Effect of Termination

When your account or subscription ends:

  • Your right to use paid functionality will end.

  • Access to your account or User Content may be restricted.

  • Any outstanding payment obligations will remain payable.

  • Provisions that are intended to continue after termination will remain in effect.

You are responsible for exporting or retaining any information you require before your account access ends.

We may retain or delete information associated with your account in accordance with our Privacy Policy, legal obligations and normal data-retention procedures.

23. Disclaimers

To the maximum extent permitted by applicable law, Pica Cast is provided on an “as available” basis.

We do not guarantee:

  • Specific creator search or matching outcomes.

  • The completeness or accuracy of creator information.

  • A creator's identity, availability or suitability.

  • The authenticity of audience information.

  • Email delivery, open or response rates.

  • Campaign performance.

  • Engagement, revenue or return on investment.

  • Compatibility with every third-party platform.

  • Continuous or error-free operation of the Service.

Nothing in these Terms excludes statutory rights or guarantees that cannot lawfully be excluded.

24. Limitation of Liability

To the maximum extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special or consequential losses, including loss of opportunity, anticipated savings, goodwill or profits, except where that liability cannot legally be excluded or limited.

To the maximum extent permitted by law, Pica Cast's total aggregate liability arising out of or relating to the Service will not exceed the total fees paid by you to Pica Cast during the 12 months immediately preceding the event giving rise to the claim.

These limitations do not apply where liability cannot lawfully be limited or excluded.

Where applicable law permits liability for a statutory guarantee to be limited, we may choose to limit our liability to:

  • Supplying the relevant Service again; or

  • Paying the reasonable cost of having the relevant Service supplied again.

Nothing in this section is intended to remove or unreasonably restrict rights available under applicable Australian unfair-contract-term or consumer-protection laws.

25. Responsibility for Claims

To the extent that a third-party claim results from your unlawful conduct, User Content or material breach of these Terms, you are responsible for reasonable losses, liabilities and costs incurred by Pica Cast as a result of that claim.

You are not responsible under this section for losses caused by our negligence, unlawful conduct or material breach of these Terms.

26. Privacy

Our collection, use, storage and disclosure of personal information are described in our Privacy Policy.

By using Pica Cast, you acknowledge that information may be processed by service providers where reasonably necessary to provide and operate the Service.

27. Changes to These Terms

We may update these Terms to reflect changes in matters including:

  • The Service.

  • Subscription plans.

  • Technology.

  • Service providers.

  • Security or operational practices.

  • Applicable legal or regulatory requirements.

Updated Terms will be published with a revised effective date.

If an update materially affects an existing paid subscription, we will take reasonable steps to provide notice before the change takes effect.

If you do not agree to a material change, you may cancel your subscription before that change becomes effective.

28. General Terms

If any part of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply.

A failure or delay in enforcing any provision does not waive the right to enforce that provision later.

You may not transfer or assign your rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations as part of a merger, restructuring, financing arrangement or sale of all or part of our business, subject to applicable law.

These Terms, together with our Privacy Policy and any plan-specific terms shown during checkout, form the agreement between you and Pica Cast concerning the Service.

29. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

You and PICA CAST PTY LTD submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from those courts, subject to any mandatory legal rights or jurisdictional protections that apply.
